The services of GWB include all services that are available on the website of GWB at www.goworkabit.com as well as all additional services that GWB may provide (hereinafter GWB services).
GWB’s Service - communication platform offered by GoWorkaBit Estonia OÜ (GWB) in order to allow natural persons and/or legal persons to communicate with one another for the purpose of provision of services.
Client - person who uses GWB’s service in order to find a service provider (natural or legal person).
Service Provider - person who uses GWB’s service for finding projects with the aim of providing their service.
Users - the Client and the Service Provider.
Service / Workbite - an assignment given by the Client, which is performed by the Service Provider.
Service Contract - contract between the Client and the Service Provider.
3.1 The substance of GWB’s Service is to establish the environment of the goworkabit.com communication platform for the Client and the Service Provider.
3.2 GWB does not enter into a contractual relationship with the Service Provider for the provision of the Service.
3.3 The Service Provider chooses a Service offer and assumes the obligation to provide a service that is described in the Client's offer chosen and accepted by the Service Provider in accordance with the Client's instructions. The place of provision of the Service is indicated in the accepted Service offer.
3.4 The Service Provider authorised GWB to register the period of provision of the Service in the register of workers and to withhold and pay the taxes and contributions payable on the remuneration.
3.5 The Service is accepted on the basis of an instrument of acceptance approved by the Client (online confirmation of the Service provided).
3.6 The Client has the right to refuse to accept the Services and sign the instrument of delivery and acceptance if the Services fail to attain the agreed result or do not comply with legislation.
3.7 GWB will remunerate the Service Provider for the proper provision of the Services in accordance with the actual volume of the Service at the rate specified in the Service offer (hereinafter the Remuneration) within 21 calendar days following the provision of the Services. The Remuneration specified in the Service offer is gross remuneration.
4.1 It is prohibited to give false information to GWB. GWB assumes that the data submitted by the Service Provider is correct.
4.2 The Service Provider warrants that:
4.2.2 the purpose of the Service provided by GWB is to offer a communication platform to the Client and to the Service Provider;
4.2.3 they will provide the Client with the Service using safe working techniques and in cooperation with the Client;
4.2.4 they will take responsibility for any fault-based material damage caused in the course or as a result of provision of the Service;
4.2.5 GWB pays the Service Provider Remuneration for provision of the Service and the Service Provider is entitled to the Remuneration after they have provided the Client with the Service;
4.2.6 payment of the Remuneration by GWB does not make GWB the Client or the employer with regard to the Service Provider;
4.3 GWB does not give the Service Provider any instructions for provision of the Service and does not supervise the process of provision of the Service;
4.4 The Service Provider agrees not to disclose, transmit or post to GWB any wrong, misleading or incorrect information and undertakes to use GWB’s Service for the intended purpose.
5.1 GWB is not liable for the correctness of data transmitted by the Client in a Service offer.
5.2 GWB is not liable for the conditions established for provision of the Service or for tools, incl. for the performance of the occupational health and safety requirements.
5.3 GWB is not liable for the submission by the Service Provider of inaccurate account details to GWB.
5.4 GWB is not liable for the damage suffered by the Service Provider in relations with the Client.
5.5 As a user of GWB’s Service, the Service Provider is solely liable towards GWB and the Client for any and all activities taking place in the framework of the user account of the Service Provider.
6.1 GoWorkaBit Estonia OÜ and GoWorkaBit Ltd, e-mail: firstname.lastname@example.org, are responsible for processing personal data in the GWB online portal. Personal data are processed at the seat of GoWorkaBit Estonia OÜ in Estonia and GoWorkaBit Ltd in London, UK.
6.2 GWB may collect personal data related to the user of the GWB’s Service by the Service Provider. Such data includes, above all, the name, contact details, current account numbers, résumé and photo of the Service Provider.
6.3 GWB uses the personal data of the Service Provider for the following activities: transfer of data to the Client for the provision of the Service, exercising any rights and performing any duties and obligations arising from law.
6.4 GWB does not disclose personal data to third parties without the consent of the Service Provider, except to the Clients of the Service, supervisory authorities, accountants and in events arising from law.
6.5 GWB retains the personal data of the Service Provider only as long as it is necessary in the case of the collected personal data and required by law. Invoice-related data is preserved by GWB in accordance with the Estonian accounting and taxation acts for seven years as of their submission to GWB. Data on any legal transactions between GWB and the Service Provider may, in accordance with the general prescription term established to civil claims in the General Part of the Civil Code Act, be preserved for ten years as of their submission to us.
7.1 These terms and duties and obligations arising from or related to them are governed by the legislation of the Republic of Estonia.
7.2 Any and all disputes arising from or related to the Agreement will be settled by the parties by way of negotiations. Failing agreement, the parties have the right to refer the dispute to Harju County Court in accordance with the legislation in force in the Republic of Estonia.
